1. Acceptance of Terms
By purchasing and using products from brainaccess.ai (the “Website”), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the Website or purchase our products.
2. Important Notice: For Research Use Only
All products sold on brainaccess.ai, including but not limited to Electroencephalography (EEG) devices and related accessories, are intended for research, scientific, educational, general wellness, or non-clinical development purposes only.
These products are not medical devices and are not intended for medical diagnosis, treatment, or any other clinical use. You agree not to use these products for any medical purposes. Brainaccess.ai and its parent company, Neurotechnology, disclaim all liability for any use of the products outside of their intended research purpose.
3. Customer Information
When placing an order, you agree to provide accurate and complete information, including:
* Full name
* Company or institution name (if applicable)
* A valid email address
* A complete shipping address
* A valid phone number
You are responsible for any issues or delays that arise from providing incorrect information.
4. Ordering and Payment
* All prices are listed in Euro (€) and do not include shipping charges, VAT, or customs duties.
* Customers within the European Union are subject to a 21% Value Added Tax (VAT) unless a valid VAT Payer ID is provided.
* Payment must be made in advance. We accept payments via PayPal, Stripe, and bank transfer.
* Orders will be processed upon confirmation of payment.
5. Shipping and Delivery
* We ship our products from our warehouse in Lithuania.
* We use DHL for all shipments. Delivery times may vary depending on your location.
* You are responsible for all shipping costs, which will be calculated at checkout.
* Any customs duties or import taxes are the sole responsibility of the customer.
6. Warranty
We provide a one (1) year warranty on our products against defects in materials and workmanship, starting from the date of purchase. This warranty covers normal consumer use.
This warranty does not cover:
* Damage caused by improper installation, misuse, or accident.
* Modifications not approved by Neurotechnology.
* Normal wear and tear.
* Products with altered or removed serial numbers or damaged warranty seals.
If a product fails during the warranty period, we will repair or replace it at our discretion.
7. Return and Refund Policy
We offer a 14-day money-back guarantee on all our products, starting from the date you receive the product.
To be eligible for a refund, the following conditions must be met:
* The product must be in its original, undamaged packaging.
* The product must be in full working order with no signs of physical damage.
* You must arrange and pay for the return shipping to a location designated by us.
Shipping charges and any applicable taxes or duties are non-refundable. Once we receive the returned product, we will inspect it and, if the conditions are met, issue a refund for the original purchase price.
8. User Accounts
If you create an account on our Website, you are responsible for maintaining the security of your account and for all activities that occur under it. You must immediately notify us of any unauthorized use of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.
9. Intellectual Property
All trademarks, content, and other intellectual property on this Website are the property of Neurotechnology. Your use of the Website or purchase of our products does not grant you any rights to this intellectual property.
10. Regulatory Disclaimers and Scope Limitations
All products sold on brainaccess.ai are NOT Medical Devices, In Vitro Diagnostic Devices (IVDs), or classified as Software as a Medical Device (SaMD). They are not intended for the diagnosis, treatment, cure, monitoring, or prevention of any disease or condition, or for any other clinical use.
All products sold on brainaccess.ai are NOT Toys and are NOT designed to comply with the specific safety requirements of the EU Toy Safety Directive (2009/48/EC). Use by children under 18 years of age is strictly prohibited. The Products are also not designed to meet all specific requirements applicable to mass-market consumer products under the General Product Safety Regulation (EU 2023/988).
Any research or development conducted with the Products does not constitute a clinical trial requiring authorization under the EU Medical Device or Clinical Trials Regulations. The products have not been submitted to, nor received clearance or approval from, any government or regulatory body (such as the FDA in the US, or a Notified Body under the EU MDR) for medical, diagnostic, or clinical purposes.
Brainaccess.ai and its parent company, Neurotechnology, disclaim all liability for any use of the Products outside of their stated intended scientific, educational, and non-clinical purposes.
11. Disclaimer of Warranties
The website and all products are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied. Brainaccess.ai specifically disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non – infringement.
12. User Responsibility
You are solely responsible for all data, content, and information you upload, post, or otherwise transmit through the Website or products (“User Content”). You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize Brainaccess.ai to use all such User Content.
13. Indemnification
You agree to indemnify, defend, and hold harmless Brainaccess.ai and its parent company, Neurotechnology against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (i) your breach of these Terms and conditions, (ii) your violation of any applicable law or regulation, or (iii) any third-party claim that your User Content infringes upon the intellectual property rights or privacy rights of that third party;
14. Final provisions
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Lithuania. All disputes arising from these Terms and Conditions shall be settled through negotiation. If an agreement cannot be reached, the disputes shall be settled in the courts of the Republic of Lithuania.
If any provision of these Terms and Conditions is held to be invalid, this will not affect the validity of the remaining provisions.
We reserve the right, at our sole discretion, to modify or replace any part of these Terms and Conditions. It is your responsibility to check the Terms and Conditions periodically for changes. Your continued use of the Website or purchase of products will constitute acceptance of the new terms.
By using a Website or purchase of products, you agree to comply with all applicable European Union laws and regulation, including any laws and regulations related to Artificial Intelligence that may come into force during your use of the Website or purchase of products.
